Apple vs Amazon in ‘App Store' Battle

Hey Amazon, congratulations on launching your new "app" store; now here's your lawsuit.

Amazon's "app" store for Android phones is open for business as of today. It's trying to grow its download audience with an enticing Angry Birds release. Apple, unamused with Amazon's use of "app store," is suing for trademark infringement for the use of "app store."

Following a fairly long marketing campaign, Amazon is offering a daily discount of a paid app. Today's is Angry Birds' Rio, which is normally 99 cents. Rio is also exclusive for Android users via Amazon's download shop.

Apple took Amazon.com to court, claiming the online retailer was not using the Apple "App Store" logo properly for its mobile developer program.

Bloomberg reports Apple filed a claim in March accusing Amazon of trademark infringement, asking the company to stop using the term "App Store."

“Amazon has begun improperly using Apple’s App Store mark in connection with Amazon’s mobile software developer program,” Apple said in the complaint. Amazon also plans to use the name with a mobile software download service, the complaint states.

Apple went on to say, “Amazon has unlawfully used the App Store mark to solicit software developers throughout the United States."
