The family of 59-year-old Jesse Garay is filing a lawsuit against LA County Metropolitan Transportation Authority.

Garay was fatally stabbed Aug. 19 during a confrontation with another passenger on Metro’s red line.

The lawsuit claims that MTA did not provide enough security and violated their own staffing policies. At a news conference Friday morning attorney Michael Alder said that because cell service is so spotty on the underground system, MTA needs to provide more available manpower.

Security responded about four minutes after the attack, the attorney said, citing a police report.

The lawsuit filed on behalf of Garay’s mother seeks unspecified compensation.

A 33-year-old man was arrested last month. Witnesses said an argument occurred between Garay and the other man at the Hollywood and Vine station.
