Grand jury transcripts reveal night of drinking

Suspect Andrew Gallo and his stepbrother had been bar hopping before the crash that killed Los Angeles Angels pitcher Nick Adenhart and two others, according to Orange County grand jury transcripts.

Raymond Rivera, Andrew Gallo's stepbrother, says the pair had gone to Johnny Carino's in West Covina where Gallo's girlfriend is a waitress. He testified the two downed beers and shots of tequila before driving to another bar called The Well in Covina.

According to police, the two were seen on surveillance tape at that bar, drinking at least three more beers and several shots of sake.

Fullerton police detective Matthew Malone told the grand jury that he asked Gallo why he was behind the wheel.

"He stated he didn't remember. But he ends up driving home because Rivera is, in quotes, 'smashed,'" Malone said.

Neither Gallo nor Rivera could remember why they were in Fullerton.

Experts also testified that based on blood taken from Gallo, his alcohol level at the time of the creash would have been .22 -- almost three times the legal limit.

Police recovered a black box device from Gallo's minivan, which -- they testified -- shows he sped up from 55 to 65 mph at the time of the collision.

Gallo is being charged with three counts of murder.
