Firefighters Won't Be Punished for Porn

The acts of alleged misconduct are outside the bounds of the two-year statute of the limitations set in the city charter.

Contrary to an earlier assertion by the fire chief and the mayor, no firefighters will be disciplined for allowing two of their engines to be used in porn movies, NBC4 has learned.

In a letter from Fire Chief Brian L. Cummings to City Councilman Dennis Zine, the chief asserts that the acts of misconduct are outside the bounds of the two-year statute of the limitations set in the city charter.

“The Fire Department cannot suspend, remove or separate a sworn member from service for acts that are over two years old,” Cummings wrote.

An investigation by the LAFD found that the videos were taken in 2008.

The letter was sent in response to a request made by Zine for an update on the fire department investigation.

According to Zine, the Fire Department plans to leave the investigation open indefinitely, which means the LAFD doesn’t have to reveal the content of its findings, including who participated and how.

"Whatever happened, they basically have clemency," Zine said. “We need to look at changing this part of the city charter.”

There is precedent for such modifications -- the city extended the statute of limitations for the LAPD in the wake of Rodney King, Zine said.

NBC4 broke the news of the investigation in late September, reporting that several firefighters allegedly allowed porn producers to use their fire engines in two adult movies that are available on one of the world’s biggest porn websites.

In one of the movies, shot at Venice Beach, LAFD Engine 263 is used as the backdrop by an actress performing lewd acts.

“Look at this fire truck,” says porn actress Charley Chase, as she climbs on the engine and repeatedly exposes herself. “Isn’t that nice.”

It appears that a group of firefighters are watching the movie being shot.

“What happened with the lady on the fire truck was inappropriate,” Zine said. “It should not have happened. But because of the timeframe...there's no discipline they can administer.”
