Officials Vacate Deportation Order for Father Detained by ICE

The father of four was arrested after dropping off one of his daughters at her middle school in Highland Park in late February.

The Board of Immigration Appeals vacated a deportation order for Romulo Avelica, a father of four whose detainment sparked outrage and rallies.

According to the National Day Laborer Organizing Network, the BIA rejected an earlier agreement on Thursday to uphold a 2014 removal order for Avelica.

Avelica was arrested Feb. 28 after dropping off one of his daughters at her middle school in Highland Park. His daugther captured the arrest on video and posted it to social media, where it reached a wide audience.

The father of four's case will now be reviewed by an immigration judge who will determine whether or not he will be granted relief that can be given to individuals who have lived in the US for an extended period of time.

Avelica has been held in custody at Adelanto Detenetion Center since Feburary, and his family have called on authorities to have him released to his family immediately.
