Murder Conviction Reversed for Mom Who Drowned Baby in Tub

She told police she drowned her daughter so the girl "wouldn't suffer" what she had suffered.

A California appeals court has ordered a new trial for a woman convicted of drowning her baby daughter in a bathtub.

The Orange County Register says the panel on Thursday reversed a first-degree murder conviction for Lucero Carrera.

Carrera was living with her mother in Santa Ana when she held her 2-month-old daughter underwater in the tub in 2012. She told police she drowned her daughter so the girl "wouldn't suffer" what she had suffered.

Carrera had been diagnosed with bipolar disorder. She had been hospitalized several times and had attempted suicide.

The appellate court said jurors should have received better instructions about considering her mental state.

The Orange County district attorney's office says it's reviewing options, which could include appealing to the California Supreme Court.
