Prosecutors Decline to Charge Torrance Teacher Suspected of Molesting Ex-Student

The Los Angeles County District Attorney's Office declined Wednesday to file a criminal case against a teacher at South High School in Torrance who was arrested on suspicion of sexually assaulting a former student in 2012.

Kevin McElwee, 49, of San Pedro, was arrested by Torrance police Monday.

A spokesman for the District Attorney's Office said it was declining to pursue a case because the two alleged victims did not want the matter prosecuted and did not want to be interviewed.

When he was arrested Monday, Torrance police said the case involved only one former student who was a minor at the time of the alleged sexual assault in 2012, although they said they were reviewing evidence to "potentially identify additional victims."

A second alleged victim was identified following McElwee's arrest, Torrance Police Department Sgt. Ronald Harris said.

Additional information about the second potential victim was not immediately available.

McElwee was arrested when detectives responded to South High School at 4801 Pacific Coast Highway to investigate the allegation after getting "a tip from the public," Harris said Monday.
