A lawsuit filed against the Los Angeles Superior Court this week argues that the automatic suspension of licenses for failing to pay traffic tickets is illegal.
The lawsuit claims that under California law, the court is permitted to notify the Department of Motor Vehicles of a licensce suspension only if the driver intentionally failed to pay the ticket or tickets. It also argues that ticketed drivers must have the opportunity for a hearing so they can explain the suit claims, their financial circumsenaces, and that people who are financially unable to pay their tickets should not be suspended.
