Beresford-Redman Defense to Argue Against Extradition

A judge ruled in July that the former reality show producer should be extradited to Mexico

Attorneys for former "Survivor" producer Bruce Beresford-Redman will ask a judge Tuesday to overturn his extradition to Mexico to face murder charges in his wife's death.

There is not enough evidence to keep Beresford-Redman in federal custody or return him to Mexico, according to defense attorneys. The 40-year-old former reality show producer is charged in the state of Quintana Roo, Mexico,  with aggravated homicide in the death of his 41-year-old wife.

The hearing is scheduled for 9 a.m.

Monica Burgos' body was found in April 2010 at a Cancun resort. Her husband reported her missing three days earlier.

Beresford-Redman left Cancun
after his wife's death. U.S. authorities arrested him seven months later at his Rancho Palos Verdes home.

In July, U.S. Magistrate Jacqueline Chooljian found
that "sufficient evidence has been presented to  establish probable cause that Beresford-Redman... committed the offense for  which extradition has been sought.''

Defense attorneys will request Tuesday that the ruling be overturned. If the appeal fails, the case might eventually be appealed to the U.S. Supreme Court.
